1. Agreement
These Terms of Use govern your access to and use of the Serena VPN application, VPN service and website provided by GABRY GAMES SRL (“Serena VPN,” “we,” “us” or “our”). By using Serena VPN, you agree to these Terms.
2. The service
Serena VPN provides a VPN connection for supported Apple devices. The service currently supports iPhone and iPad. A working internet connection and an available, compatible server configuration are required.
No account or registration is currently required. The app is currently free and has no advertising, in-app purchases or paid subscriptions.
3. Acceptable use
You may use Serena VPN only in compliance with applicable laws and these Terms. You must not use the service to:
- Engage in unlawful activity or facilitate unlawful conduct.
- Distribute malware, gain unauthorized access or interfere with systems or networks.
- Send abusive or unlawful spam.
- Infringe intellectual property or other legal rights.
- Disrupt, overload, reverse engineer, exploit or compromise Serena VPN infrastructure, except where such restrictions are prohibited by applicable law.
- Expose us, our infrastructure or other users to legal or security risk.
4. Local laws and third-party services
VPN laws and restrictions vary by country and region. You are responsible for ensuring that your use is lawful where you are located and that your activity complies with the terms of the websites, networks and services you access.
5. Service availability
We aim to keep Serena VPN available and reliable, but do not guarantee uninterrupted access, a specific location, speed, latency, bandwidth, compatibility or availability at all times. Network conditions, maintenance, technical failures, third-party networks, legal restrictions or security measures may affect the service.
We may add, remove, suspend or modify locations, connection settings, features or other parts of the service when reasonably necessary. Server availability also depends on hosting infrastructure and network conditions.
6. Security and privacy
Our handling of information is described in the Privacy Policy, including local app settings, technical information processed when requesting the server list or using a VPN connection, and processing by infrastructure operators. No security or privacy technology eliminates every risk associated with internet use.
7. Intellectual property
Serena VPN, its software, website, branding, graphics, interfaces and related materials are owned by or licensed to GABRY GAMES SRL and protected by applicable intellectual property laws. These Terms do not transfer ownership of any Serena VPN intellectual property to you.
8. Suspension or restriction
Because Serena VPN does not currently use user accounts, account termination does not apply. We may nevertheless technically restrict access to the service or particular infrastructure when reasonably necessary to address abuse, security threats, legal obligations or material violations of these Terms.
9. Disclaimer
To the maximum extent permitted by applicable law, Serena VPN is provided on an “as is” and “as available” basis. We disclaim warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the maximum extent permitted by applicable law, GABRY GAMES SRL will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data, goodwill, business opportunities or network access arising from or related to your use of Serena VPN. Nothing in these Terms limits liability that cannot legally be limited.
11. Changes to the service or Terms
We may update these Terms when the service, applicable law or our business practices change. The current version will be posted here with its update date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
